The Green Solution, LLC is a Colorado limited liability company, hereafter referred to as, “Company.” By participating in any promotions, including but not limited to raffles, contests, giveaways, special or limited time offers, hereafter referred to as “Offers,” provided by the Company, you agree to be bound by these Terms and Conditions, hereafter referred to as, “Terms.”

The Company reserves the right to amend, modify, or discontinue any Offers or Terms. You agree that you are legally eligible to access the licensed facility operated by the Company where you received these Terms. You agree that the cost of any raffle tickets purchased are to cover operational expenses of the Company and the odds of winning are based on the number of tickets sold. You agree that the advertised date, time, or location of raffle drawings or other limited promotions may be altered or discontinued at any time, by Company. Winners of Offers consent to the use of their name or likeness in future advertising. You acknowledge that any contact information provided, including but not limited to phone number, email address, or home address will not be sold, rented, or shared with third parties and will only be used to contact you for the purposes of the Offer.

Medical

Colorado Amendment 20 - The Colorado Medical Use of Marijuana Initiative, also known as Initiative 20, was on the November 7, 2000 ballot in Colorado as an initiated constitutional amendment, where it was approved.

Colorado House Bill 11-1043 - Concerning requirement for cannabis growers to register their grow site and identify all patients, be allowed no more than 500 plants at their site unless they have a waiver, in addition to various other regulations for marijuana businesses.

Colorado House Bill 10-1284 - Increasing regulation on the use, possession, cultivation, manufacture, distribution, and sale of medical marijuana.

Colorado Revised Statute 25-1.5-106 - Medical marijuana program with the Department of Public Health and Environment, powers and duties of Department.

Colorado Revised Statute 18-18-406.3 - Medical use of marijuana by persons diagnosed with debilitating medical conditions, unlawful acts, penalty, medical marijuana program cash fund.

Amendment 64 – The Colorado Marijuana Legalization Amendment, also known as Amendment 64, was on the November 6, 2012 ballot in Colorado as an initiated constitutional amendment, where it was approved. The measure legalized marijuana in the state.

CUSTOMER AGREEMENT

We enforce the following rules and regulations at all times to help us maintain our high standards and legal compliance obligations. Please read this form, initial each page, and sign at the bottom. If you have any questions, we are happy to assist.

If I am a medical marijuana patient:

I certify that a physician has previously diagnosed me with a chronic or debilitating medical disease or condition and that I have a recommendation from a physician that medical marijuana (or medical marijuana infused products) (collectively “MMJ”) might help me with such disease or condition, and that I will follow this Customer Agreement (this “Agreement”) as it applies.

I agree to allow one or more of The Green Solution, LLC and/or Infuzionz, LLC (individually and collectively, the “Center”) to make a copy of my physician’s recommendation as well as a copy of my Colorado Medical Marijuana Registry card and State Identification.

I want the Center and their personnel to act as my licensed center, as defined under Colorado law and Marijuana Enforcement Division (“MED”) rules.

I agree that the Center is authorized to grow all of my MMJ plants pursuant to Colorado law. I further agree to sign and mail all required paperwork to the Colorado Department of Public Health and Environment and the MED as required by law.

I understand and agree that the Center has, and will continue to, invest significant time and money to cultivate and harvest my plants and to provide me with MMJ. I agree that I will not authorize another center to grow my plants for me UNLESS AND UNTIL I provide the Center with 30 days’ notice prior to my changing centers or designating another center or caregiver (as defined under Colorado law and by the MED) to cultivate and harvest my allotted plants.

I understand and agree that if I let my Colorado Medical Marijuana Registry card expire, or if it is revoked, I will inform the Center immediately.

I agree to act in accordance with all aspects of Article 18, Section 14 of the Colorado Constitution and Colorado law governing MMJ.

I understand and agree that the Center will not accept any outside seeds or plants from me.

I understand and agree that any MMJ purchase I make from the Center is strictly for my personal use and will not be shared or redistributed to anyone, whether a MMJ patient or non-patient.

I understand and agree that I am only entitled to possess up to two (2) ounces of MMJ unless my physician has recommended that an increased amount of MMJ is necessary to treat my debilitating condition. I understand that personnel from the Center WILL CHECK with my physician to confirm any increased amounts or plant counts contained in such physician’s recommendation. I hereby authorize the personnel from the Center to verify such recommendations with my physician, and I likewise hereby authorize my physician to confirm this information with the Center’s personnel.

I understand that pursuant to C.R.S. 18-18-406.3, and any other applicable law, I hereby waive any confidentiality I may hold and hereby authorize any physicians or treatment professionals who have been involved in diagnosing or treating my medical condition(s) to discuss my medical conditions and information contained in my medical records with the Center’s personnel, the Center’s attorney, the Colorado Medical Marijuana Registry, the MED, and any law enforcement official if the Center is investigated or contacted by a law enforcement agency. I hereby authorize the Center and its attorney to provide the same to any law enforcement officer, Court, prosecutor or opposing counsel if necessary for the defense of a particular legal action brought against the Center or its personnel.

By receipt of this Agreement, I am also indicating that the Center and their personnel are acting as my center provider pursuant to my rights as defined in Article 18, Section 14 of the Colorado Constitution and Colorado law. I agree that I will notify the Center in writing if I no longer want them to act in this capacity.

If I am a retail marijuana customer:

I certify that I am purchasing retail marijuana (or marijuana infused products) (collectively “RM”) for my own use and consumption, that I am 21 years old or older, and that I will follow this Agreement as it applies.

I agree to act in accordance with all aspects of Article 18, Section 16 of the Colorado Constitution and Colorado law governing RM.

I understand and agree that any RM purchase I make from the Center is STRICTLY for my personal use and will not be SHARED OR redistributed to anyone. I agree to keep RM out of the reach of anyone under the age of 21.

I understand and agree that I am only entitled to possess up to one (1) ounce of retail marijuana or its equivalent of marijuana infused product if I am a Colorado resident; and one-quarter (1/4) ounce of retail marijuana or its equivalent of marijuana infused product if I am not a Colorado resident.

Both medical marijuana patients and retail marijuana customers:

I agree to never DIRECTLY NOR INDIRECTLY transport any MMJ/RM purchased from the Center to any location outside of the State of Colorado.

I understand and agree that the MMJ/RM I receive might include seeds, but those seeds are owned by the Center, and I will not attempt to grow, sell or redistribute such seeds to anyone for any reason.

I understand and agree that the MMJ/RM sold by the Center is sold “AS IS” and that the Center makes no warranty, express or implied, with respect to the quality of the MMJ/RM or its chemical composition. The center has a limited 30-day return policy on most products, However accessories are SPECIFICALLY excluded.

I understand and agree that the MMJ/RM SOLD BY THE CENTER has not been tested for contaminants or potency and that i will consume MMJ/RM with caution and at my own risk.

I UNDERSTAND AND AGREE THAT THE MMJ/RM SOLD BY THE CENTER WAS PRODUCED WITHOUT REGULATORY OVERSIGHT FOR HEALTH, SAFETY OR EFFICACY AND THERE MAY BE SERIOUS HEALTH RISKS (AS WELL AS ALLERGENS) ASSOCIATED WITH THE CONSUMPTION OF MMJ/RM. I AM ASSUMING ANY AND ALL RISK IN MY CONSUMPTION OF MMJ/RM.

I understand that there may be additional SERIOUS and unknown health risks associated with the consumption of MMJ/RM for women who are pregnant, breastfeeding, or planning on becoming pregnant.

I agree not to consume MMJ/RM in any manner that could endanger the safety or wellbeing of others.

I AGREE not to consume MMJ/RM in any manner while on or within the premises of the center NOR IN ANY OTHER LOCATION THAT IS NOT PERMITTED BY LAW.

I understand that the Center may be engaged in the business of cultivating and supplying MMJ/RM in a manner consistent with Colorado law, rules and regulations (that are subject to drastic change and regulatory development) and require strict compliance by all participating parties, including myself. I understand that purchasing and possessing MMJ/RM remains unlawful under federal law and it is important for me to consult with independent legal counsel regarding any legal risks that could result from my purchasing, possessing and consuming MMJ/RM.

I understand that MMJ/RM may cause a number of symptoms including, but not limited to, drowsiness, lightheadedness, dizziness and loss of balance, and I agree NOT to operate any motor vehicle or other mechanical device while under the influence or impaired by MMJ/RM. I understand that doing so is a violation of Colorado law and is not protected by Article 18, Section 14 nor Article 18, Section 16.

I agree that in the event of any controversy or claim arising out of or relating to this Agreement, or a breach thereof, the parties hereto shall first attempt to settle the dispute by mediation. If settlement is not reached within sixty (60) days after service of a written demand for mediation, any unresolved controversy or claim shall be settled by binding arbitration. The number of arbitrators shall be three. The place of arbitration shall be in Denver, Colorado. Colorado law shall apply. Judgment on the award rendered by the arbitrators may be entered in any court having jurisdiction thereof.

I agree that any action related to this Agreement will be governed, controlled, interpreted, and defined by and under the laws of the State of Colorado, without giving effect to any conflicts of laws principles that require the application of the law of a different state. I hereby expressly consent to the personal jurisdiction and venue of all state and federal courts located in the City and County of Denver, Colorado for any lawsuit filed that arises from enforcement of any binding arbitration judgment related to this Agreement.

I agree that if any party to this Agreement commences any action or proceeding against another party relating to any controversy or claim arising out of or relating to this Agreement, the prevailing party shall be entitled to recover from the other party all reasonable costs in connection therewith, including reasonable attorneys’ fees.

By receipt of this agreement, I agree to the following:

I have read and understand this Agreement. I understand that failure to abide by these policies may result in my membership being terminated if I am a medical marijuana customer and/or result in the Center refusing to sell me MMJ/RM.

I am indicating that I am of lawful age and sound mind, and do now hereby release, acquit, and forever discharge the Center from all actions, claims, demands, or damages accruing to me from any known or unknown injury, loss, or damage sustained by or to me. This release shall remain in force and run concurrently with my membership with the Center or with my current and continuing patronage with the Center, as the case may be. I further agree to indemnify and hold the Center harmless from any and all injuries or damages resulting from photo images obtained, any visit to a Center facility, or the use or misuse, or unlawful transport, possession, distribution or consumption of MMJ/RM obtained from the Center.

This privacy policy provides information and serves as notice to you of The Green Solution, LLC’s and its affiliates (“we,” “us,” and “our”) policies and practices regarding the collection, storage, use, and transfer of certain information, including your personal information, regarding our websites and applications (collectively the “Service”). Visitors and other end users of our Service are collectively referred to in this Privacy Policy as “you,” “your,” and “users.”

Information We Collect

Cookies, Beacons & Other Technologies

We use cookies, web beacons, and other tracking technologies in order to improve our Service and improve our business, marketing and advertising activities.These technologies may be implemented by us or our third-party partners.  We and our third-party partners may generate log files which track our users’ use of our Site. Please note that we do not recognize “Do Not track” requests for internet browsers.

We use the types of information described in this Privacy Policy for any lawful purpose, primarily to conduct business activities related to providing you with the Service, as well as develop, improve and manage the use of our Service.  These uses may include administration, marketing, communication, product or service delivery, advertising, customization, maintenance and other legitimate purposes.
